At European level, the <strong><a href=\"https:\/\/ec.europa.eu\/social\/main.jsp?catId=1202&amp;intPageId=5581&amp;langId=en\" rel=\"nofollow noopener\" target=\"_blank\">European Accessibility Act (EAA)<\/a><\/strong> imposes new regulations <strong>starting from June 28, 2025<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The EAA was implemented through the <a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2019\/882\/oj\/ita\/pdf\" rel=\"nofollow noopener\" target=\"_blank\">Directive (EU) 2019\/882<\/a> of the European Parliament and of the Council of 17 April 2019 and establishes that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong>All websites or apps of companies with more than 10 employees and\/or a turnover of more than 2 million euros that deal with certain products or services<\/strong><\/em> <em><strong>must be fully accessible.<\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>E-commerce sites<\/li>\n\n\n\n<li>e-books<\/li>\n\n\n\n<li>ATMs, ticketing and check-in systems<\/li>\n\n\n\n<li>Transport related services such as trains, buses, planes<\/li>\n\n\n\n<li>Banking systems<\/li>\n\n\n\n<li>Computers and Operating Systems<\/li>\n\n\n\n<li>Material related to digital TV services<\/li>\n\n\n\n<li>Telephony and related services<\/li>\n\n\n\n<li>Streaming services and access to other audiovisual materials<\/li>\n<\/ul>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Companies will have to ensure that websites<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Are compatible with assistive technologies.<\/li>\n\n\n\n<li>Allow navigation accessible via assistive devices.<\/li>\n\n\n\n<li>They offer a clear and accessible interface for all users, with options to enlarge the text, adjust the PA and for Companies<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The accessibility statement is<strong> the tool through which Administrations and Companies make the accessibility status public<\/strong> of every website and mobile application they own.<br>It is mandatory for all the entities indicated by the <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:2004-01-09;4!vig=\" rel=\"nofollow noopener\" target=\"_blank\">Law n.4\/2004<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Declaration <strong>is drafted and published using only the application <a href=\"https:\/\/form.agid.gov.it\" data-type=\"link\" data-id=\"https:\/\/form.agid.gov.it\" rel=\"nofollow noopener\" target=\"_blank\">form.agid.gov.it<\/a><\/strong>, created by AGID in compliance with the model established by EU Directive 2016\/2102.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>AGID (Agency for Digital Italy) has provided the <a href=\"https:\/\/www.agid.gov.it\/sites\/agid\/files\/2025-05\/Linee_Guida_accessibilita_servizi_consultazione.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Guidelines on accessibility of services<\/a><\/strong> in implementation of art. 21 Legislative Decree no. 82 of 2022<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The PA must publish an Accessibility Statement for each website and mobile application for which it is responsible.<\/strong><br><br><strong><em>From 23 September 2025, all companies subject to the regulation In particular, the key phases of monitoring are illustrated, from <strong>definition of the observation period<\/strong> to the methods used, up to the <strong>sample composition<\/strong> of sites and apps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Recommended pages for in-depth accessibility monitoring<\/strong>:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>the home page;<\/li>\n\n\n\n<li>the login page;<\/li>\n\n\n\n<li>the site map;<\/li>\n\n\n\n<li>the contact page;<\/li>\n\n\n\n<li>the help page and pages containing legal information;<\/li>\n\n\n\n<li>at least one relevant page for each type of service offered by the website or<br>from the mobile application and for any other intended primary use, including<br>search functionality;<\/li>\n\n\n\n<li>the pages containing the accessibility statement and the pages with the feedback mechanism;<\/li>\n\n\n\n<li>examples of pages that appear substantially distinct or exhibit a type of<br>different content;<\/li>\n\n\n\n<li>at least one relevant downloadable document, where applicable, for each type of service<br>offered by the website or mobile application and for any other intended primary use;<\/li>\n\n\n\n<li>any other page considered relevant by AGID;<\/li>\n\n\n\n<li>a number of randomly selected pages equal to at least 10 % of the sample defined in<br>previous points (1-10).<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"to-sanzioni\">S<strong>Actions for Non-Compliance with Regulations: Stanca Law and European Accessibility Act<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Private companies that offer services to the public through websites or mobile applications, with a <strong>average turnover in the last three years exceeding 500 million euros<\/strong>, in case of non-compliance, may be subject to <strong>administrative pecuniary sanctions up to 5% of the turnover<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the <strong>companies with a turnover of less than 500 million euros<\/strong>, at the moment, according to article 24, paragraphs 1, 2, 3 and 4 of Legislative Decree 82\/2022 <strong><em>Fines range from a minimum of \u20ac5,000 to a maximum of \u20ac40,000<\/em><\/strong> based on the extent of the non-conformity, the number of non-compliant products or services, as well as the number of users involved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"to-5\">Take Action Now!
